either company should take it on the chin, but my thought would be that you buy something from a store and it has a warranty a store should in good faith as good customer service replace it no questions ask. They replaced my Vita that was out of warranty by a month without any issues. Obviously, receiving a refund/replacement from Target would be ideal, as it's more or less instantaneous. Also, for whatever it's worth, the defects certainly were present in the warranty period, but they subsided until coming back with a vengeance about a week ago.

However, Target being Target – they may just refund you on the spot. I had assumed it was relatively new and he was looking for an exchange.
